Teenager Charged With Defiling and Infecting Six-Year-Old With HIV Virus

A fifteen-year-old minor has been charged with defiling a six-year-old minor and infecting them with the virus. The juvenile is a Grade Eight student at a school based in Moiben Sub-county and is said to have been with the HIV virus. He was also charged with defiling another minor which is contrary to section 8 (1) read with Section 8 (2) of the Sexual Offences Act, 2006.

It is alleged that the minor defiled the minor on different days between January and April 2024 at the Kambi Nairobi area in Kimumu estate. The juvenile was also charged with another count of transmission of the virus contrary to section 26 of the Sexual Offences Act, 2006.

The accused was presented by lawyer Oscar Oduor but denied the charges before an Eldoret court. Lawyer Oduor pleaded with the court to release him on lenient bail conditions considering that he is a child who needs protection.

Mr Oduor shared with the court, “Looking at the case before us, the court will appreciate that both the accused and the victim are all children in need of care and protection, I respectfully request this court to release the accused on lenient bail terms,”

Following the accused’s lawyer, the Eldoret court released him on a sh50,000 bail. The matter will be reviewed on 13th May for directions on how to conduct pre-trial proceedings since the case involves two minors.
