partenaires avec lesquels ils ont engendr\u00e9 un enfant, pour les contraindre \u00e0 assumer toutes les d\u00e9penses financi\u00e8res des enfants.<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Le p\u00e8re et la m\u00e8re ont d\u00e9sormais une responsabilit\u00e9 \u00e9gale envers leurs enfants et aucun n&#039;a de charge sup\u00e9rieure ou inf\u00e9rieure, a statu\u00e9 la Haute Cour de Milimani, Nairobi.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">La juge Abida Ali Aroni, qui statuait sur la requ\u00eate d&#039;un homme contestant la d\u00e9cision d&#039;un tribunal inf\u00e9rieur de lui r\u00e9partir la charge financi\u00e8re plus lourde li\u00e9e \u00e0 l&#039;entretien d&#039;un enfant de trois ans qu&#039;il avait engendr\u00e9 avec son ex-\u00e9pouse, a statu\u00e9 que les couples s\u00e9par\u00e9s devraient avoir un responsabilit\u00e9 parentale conjointe et \u00e9gale.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Le juge Aroni s&#039;est appuy\u00e9 sur l&#039;article 24 de la loi sur les enfants qui stipule\u00a0: <\/span><i><span style=\"font-weight: 400;\">\u00ab\u00a0Lorsque le p\u00e8re et la m\u00e8re d&#039;un enfant \u00e9taient mari\u00e9s au moment de sa naissance, ils auront la responsabilit\u00e9 parentale \u00e0 l&#039;\u00e9gard de l&#039;enfant et ni le p\u00e8re ni la m\u00e8re de l&#039;enfant n&#039;auront de droit sup\u00e9rieur ou de r\u00e9clamation contre l&#039;autre.<\/span><\/i><span (\u00c9toile)<\/figcaption><\/figure>\n<p><span style=\"font-weight: 400;\">Le tribunal d&#039;instance avait ordonn\u00e9 \u00e0 l&#039;homme de payer 97 000 shillings ($970) pour les frais de scolarit\u00e9 du mineur, de financer d&#039;autres d\u00e9penses li\u00e9es \u00e0 l&#039;\u00e9cole et de payer 20 000 shillings ($200) par mois pour la nourriture.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Dans l&#039;ordonnance contest\u00e9e du 13 septembre 2019, la m\u00e8re devait offrir au mineur un abri et des v\u00eatements et payer la nounou. L&#039;homme a \u00e9galement \u00e9t\u00e9 autoris\u00e9 \u00e0 rendre visite \u00e0 l&#039;enfant le samedi et \u00e0 ramener le mineur le dimanche apr\u00e8s-midi, les week-ends alternatifs et la moiti\u00e9 des vacances scolaires. Les deux parties devaient maintenir une couverture maladie pour l&#039;enfant.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"It_takes_two_to_tango\"><\/span><strong>Il faut \u00eatre deux pour danser le tango<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Tout en suspendant la d\u00e9cision du magistrat et en modifiant les ordonnances \u00e9mises, le juge Aroni a ordonn\u00e9 \u00e0 l&#039;homme et \u00e0 son \u00e9pouse de partager \u00e0 parts \u00e9gales les frais de scolarit\u00e9 et les frais li\u00e9s \u00e0 la scolarit\u00e9 du mineur jusqu&#039;\u00e0 nouvelle d\u00e9cision du tribunal.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><em>\u00abLes deux parties ont un emploi salari\u00e9 et gagnent des revenus substantiels, de sorte qu&#039;aucun d&#039;entre eux ne devrait avoir de difficult\u00e9 \u00e0 assumer des responsabilit\u00e9s plus \u00e9lev\u00e9es que l&#039;autre. Tous deux devraient se rendre compte que ce n\u2019est plus la m\u00eame chose depuis leur divorce et ils devraient par n\u00e9cessit\u00e9 parvenir \u00e0 un consensus sur l\u2019\u00e9cole qu\u2019ils seront tous les deux \u00e0 l\u2019aise de payer.<\/em> dit-elle.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Dans les nouvelles ordonnances, l&#039;homme ne paiera \u00e9galement que 10 000 Sh ($100), qui couvriront les frais de nourriture et de v\u00eatements du mineur en attendant l&#039;audience et la d\u00e9cision de l&#039;appel.
